FDA sekarang telah menolak PMTA dari 295 perusahaan vape.

FDA mengumumkan hari ini bahwa 127 produsen vaping tambahan telah menerima Perintah Penolakan Pemasaran (MDO) untuk produk yang diajukan dalam Aplikasi Tembakau Pra-Pemasaran (PMTA) sejak pembaruan terakhir pada 10 Sept.. MDO baru ini mewakili sekitar 100.000 produk—hampir semua e-liquid botol dengan rasa selain tembakau atau mentol.

Sejak 26 Agustus, 295 produsen telah menerima MDO untuk lebih dari 1.089.000 produk. Sejak tenggat waktu 9 Sept. untuk produk yang tidak berizin untuk dihapus dari pasar, Pusat Produk Tembakau FDA belum mengizinkan satu pun produk vaping untuk pemasaran.

Produk dengan PMTA yang ditolak seharusnya dikeluarkan dari pasar atau menjadi subjek penegakan FDA lebih lanjut. FDA telah mengatakan bahwa prioritas penegakan tertingginya mencakup produk yang telah menerima MDO atau tidak pernah diajukan untuk ditinjau. Namun, semua produk yang tersedia saat ini secara teknis tetap berada di pasar di bawah kebijaksanaan penegakan FDA, termasuk produk dari produsen vape pasar massal seperti Juul Labs dan merek Vuse dari Reynolds American.

Bersama dengan gelombang pertama MDO, FDA mengumumkan standar yang sebelumnya tidak dipublikasikan yang meminta PMTA untuk produk beraroma selain tembakau dan mentol untuk menunjukkan “bukti ilmiah spesifik produk yang cukup untuk menunjukkan keuntungan yang cukup bagi perokok dewasa yang akan mengatasi risiko yang dihadapi oleh remaja.”

Untuk pertama kalinya sejak FDA mengumumkan persyaratan itu, FDA telah mengeluarkan penolakan kepada produsen sistem terbuka yang memiliki sumber daya untuk menyertakan bukti semacam itu dalam PMTA mereka. Hari ini lebih awal, kami melaporkan bahwa Turning Point Brands dan AVAIL Vapor termasuk di antara perusahaan yang menerima MDO minggu ini untuk produk vaping beraroma.

Lainnya yang diyakini telah mengajukan bukti ilmiah yang luas dalam PMTA mereka juga menerima MDO, termasuk produsen lini Bidi Stick sekali pakai. Beberapa produsen e-liquid terkenal dan lama juga menerima MDO, termasuk Beard Vape Company, Cosmic Fog, Ruthless dan Mister E-Liquid.

Meskipun FDA mengatakan telah mengeluarkan 295 MDO, daftar tersebut hanya berisi 240 nama. Badan tersebut mengatakan produsen yang mengeluarkan penolakan untuk produk yang saat ini tidak dipasarkan tidak disebutkan.
